Supporting the Parties for Amicable Agreements and Settlements
P.M.&E.'s experienced team is available to assist the Employers and Contractors in the delicate phase of out-of-court settlement of disputes (settlement, amicable settlements, use of the Principal Expert) especially while the Project is ongoing and the benefits of a timely course correction are undeniable.
P.M&E. can support the assisted Party, or both Parties, with unbiased studies and evaluations on the issues or claims subject to the tentative agreement. These studies provide a range of probable outcomes and risks to be considered while planning the dispute strategy or can be employed as a basis for discussion and consequent settlement of the dispute through a joint agreement between the Parties.
Assistance to the legal team for the preparation of lawsuits or arbitrations
Working alongside leading law firms, P.M.&E. offers specialised technical consultancy, in favour of the Plaintiff or Defendant, for disputes regarding public and private construction Projects.
Within the framework of a judicial process, P.M&E. as technical consultant, assists the lawyers starting from the preparation of the lawsuit, collecting evidence and supporting particulars for the claims or by conducting independent analyses to improve the prospected results. These services can be performed effectively in favour of both the plaintiff and the defendant.
P.M.&E., thanks to many years of experience in the forensic field and with its own method of comprehensive analysis of the contract performance, supported by effective graphics, offers useful tools for the lawyer to understand technical aspects, as well as facts and circumstances that affected the Project and the relevant distribution of risks and responsibilities. These powerful tools allow a more effective management of the lawsuit or arbitration strategy.
Expert Witness Services
P.M.&E. associates, experienced in forensic and technical consultancy, may be nominated as Party's Technical Consultant in case the intervention of a specialised expert witness is required in the course of a civil case under Italian laws. The role is similar the Expert Witness as defined in most common laws systems.
The appointed consultant will employ P.M.&E. methods of comprehensive analysis supporting the claims with clear and unambiguous graphic reconstruction of the fact and circumstances affecting the Projects, that is P.M.&E.'s distinctive feature.
The combination of effective graphics and a careful expositive dialectic allows for an immediate overview of the Project development over time and focus the attention on the critical issues triggering anomalous trends, delays, inefficiencies… that led one party or the other to claim for damages.
